Cancellation and Liability Policy

By signing up for a Madagascar Journeys trip, each participant agrees to the following terms and conditions.

Madagascar Journeys is owned by a tour leader and guide and acts as an independent trip organizer throughout Madagascar. By signing up for a Madagascar Journeys trip, each participant agrees to the following terms and conditions.
 

Madagascar Journeys strives to make each and every trip a success for their clients and place extreme importance on their safety and well-being. It is crucial however, that each client realizes that they are responsible for making themselves aware through State Department Advisories or Tourist Offices of their countries or other pertinent sources of information of the inherent risks and thus, he/she is responsible for taking the relevant decisions.


COVID-19 WAIVER

 

By making a booking, you acknowledge the highly contagious nature of COVID-19 pandemic. You are aware that exposures to such viruses or diseases are an inherent risk of traveling that cannot be controlled or eliminated by Madagascar Journeys, and the client voluntarily assumes the risk, that he/she may be exposed to or infected by COVID-19 while traveling and it may result in personal injury, illness, permanent disability or death. You acknowledge that due to the uncertainty of the travel at this time, your trip may be postponed or cancelled, or changes may be made to the itinerary due to the closures of certain sites or activities, for which there are no refund. Also, you understand that you may become sick before the trip and may not be able to travel and such cancellation will be subject to our cancellation terms.

You acknowledge that you may become sick during the trip and that your travel plans may change, for example you may be asked to quarantine for part or all of your trip, or you may be asked to return home earlier, for which we will not be liable.

 

LIABILITY


Madagascar Journeys assumes and incurs no liability for any events over which we do not have direct control and may impact the trip as a result of any weather event, war, unrest, political or military conflicts, insurrections, riots, strikes or other act of God which may occur anywhere in the world that may impact the trip like earthquake, volcanic eruption, hurricane. Also, for any loss, damages, medical reasons like, death in the family, or invalid documents presented to the local authorities. They shall not be invoked to obtain a refund or an exemption from payment of the due balance in the case of cancellation.

Furthermore, there will be no refund due to the fear of travel from actual or threatened health, political, terrorist activity, epidemic, pandemic, physical injury, quarantine or other similar events.

For the airline default, any delays or cancellations of international or domestic flights, only the airline company is responsible and takes in charge of any assistance and compensation thereof. In case it may affect the trip, no refund or compensation is made whatsoever. Also, all extra charges involved by this (repurchasing of a new air ticket, accommodation, meals and all types of transfers) are at the client's charges only. Purchasing the international and domestic flight tickets are directly at the client's responsibility and can be bought online.

The trips that Madagascar Journeys organizes are sometimes far away from any infrastructures and/or in difficult areas. Each participant must be aware of the local risks (poor road conditions, medical centers are not always nearby, difficulty in communication accessibility, bad sanitation infrastructures). During the travel, luggage might be transported by rudimentary means (put on rooftop of the vehicle) and should be adapted to such conditions. No compensation for any damage should be asked. Each participant is responsible for all their own fragile items (glasses, electronic devices, ...)

Please note, no refunds will be made for any service provided in the itinerary that you do not use.

TERMS OF PAYMENT

​

- 30% (thirty percent) non-refundable deposit of the total amount of the trip cost will be wired to our bank account as soon as you received our tour contract form. Please send us proof of the bank when you have transferred the deposit to our account. In our side, we will inform you as soon as we received the payment. The banking information will be provided at the time of booking, and you will be responsible to pay any fees related to the transaction charged by your bank.

- The remaining balance is due no later than 30 (thirty) days prior to the trip date, it must be wire transferred to our bank account.

​

A lack of payment of the balance at the mentioned time above, the reservation can be cancelled without compensation and cancellation charges are applied.

​

In the case of a registration less than a month prior to the travel date, the total sum of the chosen trip must be paid at the time of booking.

​

After registration confirmed by Madagascar Journeys, any modification to change the trip dates or itineraries will be considered as cancellation and thus, the cancellation terms will be applied.

​

Note: You may request to pay IN CASH upon arrival the balance. It is compulsory to make a written inquiry to Madagascar Journeys and must be done at the time of booking.

Price revision: the price might be reviewed in case of high fluctuation of the exchange rates or price changes made by the suppliers or hotels. Client will be notified for those who have registered no later than 30 days before departure and he/she has the choice either to cancel the contract or comply to it.

CANCELLATIONS

​

- If you cancel your trip 45 (forty-five) days or beyond, after taking away all of the incurred fees already given to all of the suppliers and hotels to book the chosen trip, we will give you a full refund of your deposit.

​

- If you cancel your trip between 45 (forty-five) to 30 (thirty) days before the chosen trip will start, there is a 75% (seventy percent) penalty of the whole amount of the trip cost.

​

- If you cancel your trip 29 (twenty-nine) days to 16 (sixteen) days before the chosen trip will start, there is a 50% (fifty percent) penalty of the total amount of the trip.

​

- If you cancel your trip 15 (fifteen) days to 10 (ten) days before the chosen trip will start, there is a 75% (seventy-five percent) penalty of the total amount of the trip.

​

- If you cancel your trip 9 (nine) days to starting day of the trip, there is a 100% (hundred percent) penalty of the total amount of the trip.

Madagascar Journeys reserves the right to substitute hotels or accommodations with a similar category for those previously indicated and make any changes in the itinerary with respect to location, transportation or other trip details. Madagascar Journeys may cancel any trip prior to departure if they feel it is in the best interest of the trip and the participants to do so. Madagascar Journeys is charged with ensuring the best interest of its clients and does everything reasonably expected to ensure their safety and well-being. Madagascar Journeys further reserves the right to modify, change or cancel the itinerary as it sees fit. Participants are instructed that trip prices are based on tariffs and exchange rates in effect at the time the trip is planned and advertised and said trip prices may be subject to adjustment in the event of any changes affecting price.

Madagascar Journeys and/or their agents are acting only as agents for the passenger with respect to travel, including, but not limited to sightseeing, meals, lodge transportation and all other services whether by railroad, motorcar, motor coach, boat, ship, aircraft or any other form of transportation and Madagascar Journeys assumes no liability for any loss, damage, injury, death, accident, delay or other event which may be occasioned either by reason of defect in any vehicle or conveyance, or for any other reason whatsoever or through the acts or omissions of any company or persons engaged in conveying the passenger in conjunction with the trip. Madagascar Journeys is not responsible for any issues due allergic reactions to foods or related illnesses.

Madagascar Journeys has the right to refuse service to any individual. This refusal of service could be based on personality conflicts, complaints from other guests, safety concerns or an understanding by Madagascar Journeys staff that the tour may be too physically challenging for any particular individual. This policy can be enacted at any time prior to a trip departure. 

Additionally, Madagascar Journeys assumes no responsibility for losses or additional expenses due to delays or changes in travel schedules, sickness, weather, strike, war or other causes. All such losses or expenses will be borne by passenger. Baggage and equipment are at the owner’s risk entirely, and it is the owner’s responsibility to make arrangements to convey said baggage and have it at the proper destination. Travel and medical insurance are optional and is the responsibility of the passenger to purchase. Madagascar Journeys recommends said purchase.


Participants give permission to Madagascar Journeys to use any images taken of them on a Madagascar Journeys trip for promotional materials of Madagascar Journeys trips and their website. Participants give permission to use any quotes about the trip they send to Madagascar Journeys to be used on their website or promotional materials for their trips.

Should Madagascar Journeys be required to incur attorney fees or costs required in enforcing this agreement, or defending against terms in this agreement, the trip participant identified below agrees to indemnify and hold them harmless for all such fees and costs.

The parties stipulate and agree that mediation shall be required prior to any legal action.

The parties stipulate and agree that this agreement shall be construed pursuant to the laws of Madagascar.
